Hyundai Capital America and its affiliates ("we", "us", "our" or "Hyundai") are committed to protecting your privacy and informing you about how your information is used. In connection with our Services (defined below), we collect certain information about you and the vehicles you rent or lease through the Services.
This Privacy Policy applies to all information we collect through your access to and use of the Hyundai Evolve+ application, developed and maintained by our service provider, Motiva Ventures Inc. ("Motiva"), on our behalf, as well as any software, applications, other media form, media channel, or website related, linked, or otherwise connected thereto, as well as the services that Hyundai makes available through these, and your participation in the Evolve+ vehicle rental or lease programs (collectively, the "Services"). This Privacy Policy does not apply to information we collect that is subject to a separate privacy policy. In addition, the Services may contain links to third-party websites and services that are not owned or controlled by Hyundai. We are not responsible for the privacy practices related to or the content of such third-party websites and services, and you visit them at your own risk.

Please read this Privacy Policy carefully as it will help you make informed decisions about sharing your Personal Information with us. If there are any terms in this Privacy Policy that you do not agree with, please discontinue use of the Services.
"Personal Information" means information from or about an identified or identifiable person, including information that Hyundai can associate with an individual person.
The principal purposes for which we collect and store information, including Personal Information, are to: process your application; provide our Services, including to allow you to reserve and use the vehicles offered by dealers for rent or lease through the Services and to provide roadside assistance and other services in connection with the rental or lease; authorize payment; bill you; respond to your inquiries and otherwise communicate with you; analyze and improve our products and services; market to you, based on products and services we think you may be interested in; allow dealers to promote Hyundai products and services; confirm your eligibility to rent or lease a vehicle and participate in promotions; maintain your account with us; protect our rights; support our general business operations; and comply with our legal obligations. We may collect or otherwise process, or service providers (e.g., Motiva) may collect or otherwise process on our behalf, the following categories of Personal Information in the following scenarios:
Information that you voluntarily submit to us, such as your name, email address, postal address, or telephone number, if you include that information in a form, survey, an email, a text message, over the telephone, in an instant message, or by other means. Your telephone calls and email correspondence may be recorded or monitored for quality control, training, and similar purposes. By using these communication methods, you are consenting to the recording or monitoring of your calls and emails with Hyundai.
Information you provide if you apply to the Evolve+ program (the "Program"), including Personal Information you provide as you proceed through the stages of our application, Terms of Use, and vehicle registration process. In addition to your name and contact information, we also collect your driver's license number and the jurisdiction in which you are registered and credit card or other payment information. We may also collect information such as your driving record by ordering one or more consumer reports on you from third parties who perform motor vehicle record checks. This information may be used to process your application and, if you are approved, for the purposes described below.
Information collected when you use our Services or a Dealer Vehicle, such as information about your reservations (dates, times, locations, etc.) and your use of the Services and rental or lease of vehicles (return time, mileage, accidents, etc.) and vehicle data. We use this information to bill you, respond to your inquiries, provide and improve our products and Services and maintain your account with us, to personalize your Hyundai experience (i.e., by understanding your preferences), and to provide content and offers that we think may be of interest to you. From time to time we or our dealers may send newsletter emails. To unsubscribe from our newsletters, please follow the instructions provided in the newsletters you have received.
Information from vehicles rented through the Services, including Global Positioning System (GPS) vehicle tracking technology and other telematics technology further described in the Membership Agreement. GPS is a network of satellites that allows us to determine the location (latitude and longitude) of vehicles rented through the Services. This information is transmitted to Hyundai and temporarily stored (including while a vehicle is being rented to you by a dealer through the Services). Hyundai uses this information for a variety of important purposes. For example, we may use GPS data to help you find a car you have reserved, to provide roadside assistance when you need it, to ensure that a car is available at the place and time you have reserved, to alert us when a vehicle rented through the Services is likely to be returned late, to identify potential violations of the Terms of Use and applicable dealer rental agreement, and to locate lost or stolen vehicles rented through the Services.
Device and browsing information when you visit the Services. Our servers automatically log certain information about your use of our Services online, such as your IP address, your browser type, operating system, browser language, and service provider. We also collect information about your activities on our Services, such as the pages you visit or links you click on. The first time you visit the Services, you will be assigned a unique number, which is stored in one or more cookies on the device. These cookies help us distinguish new visitors from returning visitors and enable us to measure the effectiveness of content on the Services and refine and tailor that content to suit our visitors' interests. If you have used the Services or provided other Personal Information about yourself (for example, if you send us an email), your cookie ID can be associated with you personally.
Except as described in this Privacy Policy, Hyundai will not share your Personal Information with third parties unless we obtain your consent. We share Personal Information under the following circumstances:
With your permission, Hyundai may send you messages with offers that we believe will be of interest to you. We may also present you with offers on behalf of our dealers or allow dealers to provide you with advertising and other offers. If you do not want us to send you promotional emails, follow the instructions provided in the messages you have received. You may not be able to opt out of receiving certain messages relating to the Services, such as security alerts or other transactional communications.
We do not knowingly solicit or collect individually identifying information from children under the age of 13.
Hyundai is committed to providing you with reasonable and practical access to your information to allow you the opportunity to identify inaccuracies. If you participate in the Program, you can review and correct certain Personal Information in the Services. If you would like to access, delete and/or correct other Personal Information held by Hyundai in relation to the Services, please contact us in one of the ways provided below, and we will respond to your request in accordance with applicable law. Depending on where you live, you may have a right to lodge a complaint with a supervisory authority or other regulatory agency if you believe that we have violated any of the rights concerning Personal Information about you. We encourage you to first reach out to us at help@launchmotiva.io so we have an opportunity to address your concerns directly before you do so.
We will retain your information for as long as your account is active, as needed to provide you Services, or as required by law. Please contact us if you wish to cancel your account or request that we no longer use your information to provide you Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Hyundai has established safeguards, such as SSL encryption, to help prevent unauthorized access to or misuse of Personal Information. We use a password to help verify your identity before granting access or making corrections to any Personal Information about you. It is your responsibility to safeguard your password, which you should never disclose to a third party. If you contact us by phone, we will ask you to verify certain information related to your account before providing any access to Personal Information.
We may change this Privacy Policy from time to time, so it is advisable to review it frequently. The updated version will be indicated by an updated "Last Updated" date and the updated version will be effective as soon as it is accessible. If we make material changes to this Privacy Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your information.
If you are a California resident, California Civil Code Section 1798.83 may permit you to request information regarding the disclosure of Personal Information (as defined by California law) by Hyundai to third parties for the third parties' direct marketing purposes. In addition, pursuant to the California Consumer Privacy Act of 2018 ("CCPA"), California residents may have certain other rights concerning their Personal Information. This section describes (i) the categories of Personal Information collected and disclosed by Hyundai, subject to CCPA, (ii) your privacy rights under CCPA, and (iii) how to exercise those rights.
When we use the term "Personal Information" in this section, we mean information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.
Personal Information We Collect. During the past twelve (12) months we and our service providers have collected the categories of Personal Information set forth below, depending on how you engage with our Services. We may disclose each of these categories of Personal Information to third parties, such as our service providers for our business purposes and as otherwise described in the "How Might We Transfer Personal Information to Third Parties?" section above. We will not collect additional categories of Personal Information or use Personal Information collected for additional purposes without providing you notice.
Your Privacy Rights. In accordance with the CCPA, California residents may exercise, under certain conditions, the following privacy rights with respect to their Personal Information. Please note: you will not be discriminated against in any way if you exercise the rights listed below, which means we will not deny goods or services to you, provide different prices or rates for goods or services to you, or provide a different level or quality of goods or services to you, unless otherwise permitted by law.

How We Respond to Your Requests. We will respond to your request within 45 days. However, where reasonably necessary, we may extend our response time by an additional 45 days, provided we send you notice of such extension first. We will provide the information to you via your preferred delivery mechanism. If the information is provided to you electronically, we will provide you the information in a portable format.
Under the CCPA, only you or an authorized agent may make a request related to your personal data. Note that to respond to your requests to access or delete personal data under the CCPA, we must verify your identity. We may do so by requiring you to log into your Hyundai Evolve+ account (if applicable), provide information relating to your account (which will be compared to information we have, such as profile information), give a declaration as to your identity under penalty of perjury, and/or provide additional information. You may designate an authorized agent to submit your verified consumer request by providing written permission and verifying your identity, or through proof of power of attorney.
Please note that we will not charge you for making a request, provided that you make no more than two (2) requests per year. If you make three (3) or more requests in any given twelve (12) month period, we may refuse to respond to such requests, if determined by us to be unfounded or excessive (e.g. repetitive in nature), or we may charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested. If we refuse to act on the request, we will provide you notice and the reason for our refusal to act.
